Any attempt to use purchased mass email lists or conduct spamming practices are strictly prohibited and considered a violation of this Anti- Spam Policy and shall lead to the suspension or termination of User account and the User shall not be allowed to further access the Sendimpactt platform or its products or services.

1.1.5. Should an User engage in the purchase or use of mass email lists or conduct spamming practices, such User shall be solely responsible for any consequences, including but not limited to legal actions, fines, or penalties arising from such actions. Sendimpactt shall not be held liable for any misuse of our platform or any non-compliance with email marketing regulations by Users.

1.1.6. Sendimpactt reserves the right to monitor User’s use of our Services and Products to ensure compliance with this clause 1. We may take appropriate action, including but not limited to suspension or termination of your account, if we determine that an User has violated this clause.

1.1.7. By using Sendimpactt, User’s must agree to comply with all applicable email marketing laws and regulations and to use our services and products in a responsible and lawful manner.

2. UNSUBSCRIBE LINK REQUIREMENTS

2.1. To ensure compliance and respect for recipients' preferences, all marketing emails and newsletters sent through Sendimpactt must include a clear and prominent unsubscribe link. This unsubscribe link should be easily accessible with a single-click option and prominently displayed within the email content. Following are the implementation guidelines that must be followed:

2.1.1. The unsubscribe link must enable recipients to opt out of further communications with a single click, without requiring additional steps or information.

2.1.2. The unsubscribe link should be clearly visible and prominently positioned within the email, ensuring that recipients can easily locate it.

2.1.3. Every pre-built email template provided by Sendimpactt includes an unsubscribe link by default. Users are required to maintain this link’s presence and functionality in all email campaigns.

2.2. Following are the ways in which unsubscribe option shall be handled:

2.2.1. Clicking the unsubscribe link initiates immediate removal from the sender’s contact list and assigns the “unsubscribed” tag to the recipient’ profile.

2.2.2. Upon unsubscribing, the email campaign system automatically excludes the recipient from future email deliveries to respect their preference.

2.2.3. Users are strictly prohibited from changing a recipient’s status back to “subscribed” without explicit consent from the individual.

2.3. Failure to comply with these unsubscribe link requirements may result in account suspension or termination, as outlined in our Anti-Spam Policy.

3. ACCOUNT MONITORING AND SUSPENSION

3.1. Sendimpactt reserves the right to monitor various aspects of your email marketing activities to maintain the integrity of our platform and uphold compliance with our policies. These monitoring activities include but are not limited to:

3.1.1. Tracking the rate of undelivered emails due to invalid addresses or other delivery issues.

3.3.1. Your Sendimpactt account may be suspended without prior notice if it is found to be in violation of our policies.

3.3.2. No refunds will be issued for suspended accounts due to non-compliance with our policies.

3.4. You may be required to provide evidence demonstrating a valid legal basis for your email marketing activities. Failure to provide satisfactory proof may result in the termination of your account.

3.5. If you provide sufficient evidence of a valid legal ground for your email marketing activities, Sendimpactt will consider reactivating your account, subject to further review and verification.
3.6. You have the right to appeal the suspension or termination of your account by providing additional information or evidence to support your case.

4. HANDLING OF ABUSE REPORTS
